How To Apply For A Retained Right of Residence?

Previously, if you had the right to stay or live in the United Kingdom as a family member of either European Economic Area (EEA) or Switzerland but due to bereaved or divorce or the national sponsor left the nation, then there is a need to get the retained right of residence.

At the same token, you need to apply for retained right of residence through a particular procedure and then you can ascertain this right. To apply for this, you have to apply by post with the help of Form EEA (FM). Along with this, you need to avail passport size color photographs, a fee amount of £65, and other required documents as needed for the whole process. As you’re a non-EEA applicant, you may also need to appear for biometric at an extra cost of £ 19.20.

The documents depend upon the application for which you’re applying and you need to submit accordingly. To exemplify, if the EEA national has died and in these circumstances, you need to provide the following documents as given below under regulation 10(2).

  • A valid ID card of EEA as issued by the state of EEA or the national sponsor
  • A valid national ID card or passport of the person who is submitting an application
  • The death certificate of EEA national
  • Relationship evidence of the EEA national like a marriage certificate
  • Evidence of free movement at the time of death of EEA or had any PR proof
  • Before the death, the proof of residence in the UK as the EEA national’s family member for at least one year
  • Proof that you can run own expenses through any source of employment

After the submission of this application along with documents, it will take around six months of the process to make a decision.

If they accepted your application as a retained right of residence, then you will get a registration certificate that confirms your right of residence in the United Kingdom. You will also receive a non-EEA national residence card. Normally, this card is valid for up to five years.
